RSJ/Swenson is called upon by businesses to interview witnesses and individuals involved for statements in order to determine whether or not a case has merit.
A tactful investigation performed by a third-party is preferable when there is a situation involving harassment or discrimination.
As experienced third-party consultants, our staff interviewers have an understanding of the nature of these situations and realize that there are occasions when a matter will not be dropped. We recognize when a lawsuit might be forthcoming, and we work to prepare companies to face such an eventuality by ensuring that all aspects have been fairly researched.
We work through counsel, whether assigned by the business or recommended by RSJ/Swenson. That way, our work has the option of being privileged.
When requested, we also provide procedural and management recommendations to help ensure this situation does not occur again.

Workplace Investigations Case Studies
- A publicly traded company in Los Angeles with an executive accused of harassment by a clerical employee. A 2-week investigation determined no harassment, but the possibility of retaliation. Recommendations included a release of the employee and a new, streamlined organization structure.
- A transportation firm in Northern California where an executive accused the owner of sexual harassment and retaliation. Investigation discovered a consensual relationship, but that harassment and retaliation did not occur.
- A high technology company in Orange County, with an executive accused of racial harassment. Investigation determined there was improper management styles (yelling and intimidation), but not based on harassment. Management training for all managers and improved corporate communication techniques were implemented.
